Thomas Edward Chitty

Thomas Edward CHITTY (1827-68), elder son of Thomas (FORMS and ARCHBOLD) CHITTY and brother of Lord Justice Sir Joseph William CHITTY, was born 1827 Dec 30 in Calthorpe Street, St Pancras, and died 1868 May 4 in Blandford Square; he was educated at Harrow and Oriel College, Oxford (1845) and was admitted to the Inner Temple; called to the Bar 1855 Jan 26; clerk of assizes on the Western Circuit; also on Northern Circuit and Liverpool Assizes; of 1 and/or 7 King's Bench Walk, 1859-69; edited SMITH'S LEADING CASES; he married 1854 May 6 Mary Ann WILLES, daughter of Dr James WILLES of Cork and sister of Sir James Shaw WILLES (Mr Justice WILLES), a pupil of Thomas CHITTY. She died 1875 Jun 11, having been administratrix of her husband's estate. They had issue:

1. Sir Thomas Willes, born 1855 Jun 24, died 1930 Feb 15; educated at Winchester (where, while in Culver House under Dr FEARON, he was originally intended to be an engineer), he was admitted to the Inner Temple in 1873, joining his grandfather's pupil room. Called to the Bar in 1877 June, he joined the North Eastern circuit and also developed one of the largest junior practices in the Temple, having the advantage of being known to many of his grandfather's associates. In 1901, 'for domestic reasons', he was compelled to abandon his work at the Bar, and accepted a Mastership of the Supreme Court - a post on the solicitors' as distinct from the barristers' side of the profession. The 'domestic reasons' were probably connected with overwork at the bar. In 1919 he was knighted, and in 1920 became Senior Master and King's Remembrancer, and in 1924 was created a Baronet. In 1926 he resigned his posts, and took silk in 1927. In 1928 he was of 48 Queen's Gate Gardens and 10 King's Bench Walk. Noted for his mastery of legal principles and procedure as well as for his patience and courtesy, he is remembered in his profession for his work on revising and simplifying the Rules of Court under the Judicature Acts. He was joint secretary of the Supreme Court Rules Committee and edited 'Archbold's Practice', 'Chitty's Forms', 'Smith's Leading Cases' and 'Bullen and Leake's Pleadings'; was managing editor of Lord Halsbury's 'Laws of England' and editor-in-chief of 'The English and Empire Digest'. He also travelled extensively in Canada. He married (1st) 1888 Dec 21 Emily Eliza NEWBOLT, who died 1903 Aug 17 aged 40, daughter of the Rev Henry F. NEWBOLT and sister of Sir Francis NEWBOLT, K.C., and of Sir Henry NEWBOLT, the poet; and (2nd) 1904 Sep 1 Beatrice Maud HALE who died 1937 Mch 19, daughter of the Rev Edward HALE of Eton College. He died at 48 Queen's Gate Gardens and was buried at Brookwood Cemetery.
